A political group in Kogi state, Kogi Renaissance Group (KRG), has accused the ‎three member panel of Justices led by Justice Halima Muhammed that presided over the Kogi state governorship election petition tribunal of miscarriage of justice by giving judgement in favour of the incumbent governor of kogi state, Alhaji Yahaya Bello,  through ‘flimsy excuses’.

In a media chat with newsmen, the spokesman of the group, Abdulhamid Nuhu described the judgement given by the trial Judge as “conflicting, inexperience, lacking in knowledge, induced by greed, judgement-for-cash as well an embarrassment to the entire judicial system in Nigeria and the international community”. He said the group has forwarded a petition to the National Judicial Council (NJC).

According to the group, the decision to petition NJC became glaring after getting enough clue of bribe for judgement by the incumbent governor of Kogi state, Alhaji Yahaya Bello. The group alleged that the inducement was hatched at the top hierarchy of Appellate court‎ in connivance with top presidency member who is bent on keeping the current governor.

“A top Judge in the Appeal Court, sources revealed drafted the weighty judgement that involved James Abiodun Faleke of the APC and Capt Idris Wada of the PDP against Yahaya Bello hence the incoherent, disorganised ‎reading, corrections and punctuation by the presiding Justice Halima Muhammed at the floor of the court were judgement was been delivered under the guise of malaria infection which led to the dismissal of  both petitions.

“The decision of the two corrupt Justices and their plans to scuttle the judicial process was first noticed during the final submission of written addresses of the parties involved in the petition when lawyers of Alhaji Yahaya Bello, INEC and APC argued for the dismissal of the petitions of the the two leading contestants in person of Capt Wada and Hon. James Abiodun Faleke for lacking in merit arguing strongly that Bello’s emergence through substitution as normal, Nuhu said.

Nuhu wondered how Judges of this callibre are no longer current with the new legal reports and constitutional provisions faulting the Judge decisions to give a political party votes cast during elections citing supreme court Judgement as an abeyance, ignorance and deserving of sanctions from the apex court, saying the issue of votes casted in an election has long been settled to belong to candidates and not political parties.

“She even went further in her Judgement that the panel cannot distinguish between the votes cast for Abubakar Audu and Yahaya Bello. This is quite disgusting and smacks of suspicion and foul play.”Even a lay man on the street knows the number of votes cast for Abubakar Audu and the supplementary governor, Alhaji Yahaya Bello”

Abdulhamid noted that world over, there is no were forensic report is adopted as exhibit in the court of law and thrown out at the end of the day. Aside other anomalies of  election to the office of the governor without a deputy, the candidate for the governorship seat not voting for himself during election which was all declared as constitutional by Justice Halima Muhammed’s Judgement, saying Nigerian Judiciary is truly the root, the hub and the harbour of all forms of corruption in this country in connivance with politicians who have no fear of God.

He appealed to the chief Justice of Nigeria, Justice Muhammed Mahmud not to relent in bringing corrupt Judges to justice.

He promised to mobilise non-governmental oranisazations, civil societies and the international community to salvage Kogi state from its current political logjam and maladministration orchestrated by some clique of Nigerians at the corridor of power using federal might.
