Echocho’s Candidacy: Court Restrains PDP on Rerun Primaries

A Federal High Court in Abuja, yesterday, restrained the Peoples Democratic Party (PDP) from going ahead with the Kogi State governorship primaries, slated for today.

Justice Bilikisu Aliyu had granted the restraining order following the motion ex-parte application by Mr. Umaru Lawan, asking the court to put the primary on hold pending the determination of the motion on notice.

Justice Aliyu had granted leave to the applicant to apply for an order of mandamus to compel the Independent National Electoral Commission (INEC) to continue to retain in its records, the name of Alhaji Jubrin Isah (a.k.a Echocho) as the candidate of the PDP in Kogi State, being the winner of the primary election conducted on 9th January, 2011.

The leave also covered any request for an order prohibiting and restraining the PDP from holding any other primaries outside the one held on 9th January, 2011 which was won by Echocho.

Lawyer to Lawan, Mr Sunday Ameh (SAN) had moved the ex-parte application just as the judge granted the request after being satisfied with the materials placed before it by the applicant to show that he was qualified to make the request.
