The N10 Billion suit preferred against the Attorney General of the Federation, Shehu Malami by Senator Atai Aidoko Ali has been referred back to the Chief Judge, Federal High Court Abuja for re-assignment on the premise of allegations of bias against Judge Binta Nyako.
Justice Nyako presided over two high profile cases that borders on the soul of Kogi East Senate seat that had lingered for over three years. The judge felt slighted with the allegation of the plaintiff at the earlier decision that boarders on self interest, clash of interest and other likely circumstances.
Aidoko instituted the suit after stumbling on a letter written by the AGF to INEC for the revalidation of the certificate of return withdrawn from APC candidate, Abdulrahman Abubakar and withdraw the one with the current senator. According to Aidoko, the letter from Malami is undemocratic.
INEC however turned down the request of the Attorney General, describing it as unconstitutional. INEC reportedly told Malami that it is only a court of competent jurisdiction that can direct on such instructions.
