It is pertinent to state that we the undersigned honourable members of Kogi State House of Assembly do hereby give you this notice of gross misconduct in the performance of the Executive Governor of Kogi State Prince Abubakar Audu who is guilty of gross misconduct in the performance of the functions of his office.

ACTS OF GROSS MISCONDUCT WHICH PRINCE ABUBAKAR AUDU IS GUILTY OF are as follows:

1. The appointment of a special adviser for international projects and General duties in the person of Mr. Dan Okolo who thus becomes the 5th special adviser without recourse to the Kogi State house of Assembly. This is against the position of Four Special Adviser, which the House earlier granted him. This is an act of gross misconduct and a breach of section 196(2) of the constitution of the Federal Republic of Nigeria, 1999.

2. Another germane gross misconduct against the Executive Governor of Kogi State Prince Abubakar Audu is the official instruction which he gave to the Hon. Commissioner for Finance Mr. J. N. Molemodile and the Accountant General Mr. Sanni Teidi not to appear before the House any longer despite the fact that at the House plenary sitting of the 5th July, 2000, the said Hon. Commissioner of Finance and Accountant General did appear before the house and both of them took oath before the House to give evidence regarding the implementation of the new minimum wage whereon the Hon. Commissioner for Finance, gave evidence in part. Having refused to bring the May and June allocation papers and other relevant documents which the House told him to bring of which the House adjourned its sitting to 3pm on the same day being the 5th of July, 2000. At the resumed sitting the said officer refused to appear before the House again because they were instructed by the governor Abubakar Audu not to appear before the house. Till Abubakar Audu tenure expired this duo never appeared before the House again.

This act of a gross misconduct which entitles him to be removed from office as the Executive Governor of Kogi State does not qualified Audu to serve Kogi again and that will never happen in this dispensation.

3. Another misconduct by Abubakar Audu is the flagrant refusal to pay pensioners who have long retired from the services of Kogi State government after years of meritorious service to their father land. The refusal to pay their pensions and gratuities and failure to review the state civil service pensioners salaries in accordance with section 210(2) and (3) of the constitution of the Federal Republic of Nigeria, 1999 amount to breach of the constitution which entitles him to be removed as the Executive Governor of Kogi State. Pensioners, civil service workers will you vote a governor who never cares about you? Remember Idris Wada is even worse in this aspect of Pensioners and civil servants.

4. Another gross misconduct by Prince of Capua Abubakar Audu is the failure and refusal to maintain a special account to be called State Joint Local Government Account into which shall be paid all allocations to the Local Government Councils of the State. This again is a violation of th provision of section 162(6) of the Federal Republic of Nigeria.

Due to the refusal of the governor to ensure that there is a State Joint Local government Account the state has not given any percentage of the total internally generated revenue to any Local Government within its area of jurisdiction.

This is even worse than the state of Local government / State relationship today in Nigeria that cause every Nigerian agitating for Local Government fiscal autonomy.

5. Audu another gross misconduct is the refusal to use the Ecological Fund of the sum of N67,306,400.00 (Sixty Seven Million, Three Hundred and Six Thousand, Four Hundred Naira Only) for the purpose of which it was meant as at October to December 1999.
Instead he caused the same to be diverted which in the opinion of the Assembly is an act of gross misconduct.

6. Another misconduct which in the opinion if Assembly amounts to gross misconduct committed by Audu is the flagrant refusal to implement the Federal Government approved national minimum wage vis a vis the structure slated and adopted by the Federal Government and approved and passed into law by the National Assembly.

THE PARTICULARS OF THIS VERY ACTS WHICH IN THE OPINION OF THE HOUSE AMOUNTS TO GROSS MISCONDUCT IS AS FOLLOWS:

A. That whereas the National Assembly did pass an act on the implementation of the new minimum wage Prince Abubakar Audu the Governor of Kogi State caused another SATANIC SALARY STRUCTURE to be produced in Kogi State which has threatened and affected the peace of Kogi State.

B. That the structure “satanic salary table” was unilaterally structured by Prince Abubakar Audu in collaboration with his agents, servants and privies in the Executive Council e.g. Commissioner of Finance, etc without complying with the law passed by the National Assembly on the Nationally structured new minimum wage.

7. Another vital misconduct is the unilateral appropriation and expenditure of funds over and above the required amount /estimates stated in the 1999 Appropriation Law as it relates to some various heads and sub heads in the said Appropriation Law of 1999 which acts/actions in the opinion if the House of Assembly amount to gross misconduct.

8. Another gross misconduct committed by Abubakar Audu is the calculated effort thwart the effort of building a cement factory in Kogi State by making the state a sales outlet for a foreign partner which is not contained in the year 2000 appropriation law.
Governor Audu then upon his arrival from Israel, China and London said through the radio Kogi and NTA Lokoja and the graphic Newspaper of the 5th July, 2000 that samples of the Kogi State Cement would come from the prototype plant of technical foreign partner which is not contained in the year 2000 appropriation law.

9. Another gross misconduct by the then governor is the numerous unbudgeted expenditures on foreign trips aimed at satisfying his selfish /personal interest without the approval of the State House of Assembly

10. Another germane gross misconduct is the fact that the Prince Abubakar Audu in connivance with his agents, servants or privies who are now at large threatened to kill all Honourable member of the Kogi State House of Assembly.

PARTICULARS OF ACTS OF GROSS MISCONDUCT

A. The executive Governor and his agents, servants etc caused various death marks/inscriptions to be boldly written on official residence and various vehicles of Honourable members with a vehement threat that they will all be killed in the shortest possible time

B. The films, pictures and photographs of such death marks/inscriptions which are put in the official apartment /residence and vehicles of honourable members shall be relied upon during the hearing of all these misconducts.

C. That public funds were expended on non government official on the said dastardly trips.
I have all the particulars of these ten misconducts. But one thing is sure Abubakar Audu know how to bribed his way through all case including the one in court with EFCC.

If you see what he spent 11billion naira on. He spent so much bribing the state assembly, the judiciary and also to on the commissioners just to win their support. Kogi State is this the kind of governor we need at this point in time? I think we deserve a better servant leader. Vote wisely vote justice, equity and fairness.
