A Kogi state High Court sitting in Iyara has for closed a defendant’s case by invoking the High court rule for his persistent absent in court to defend the chieftaincy dispute case instituted by the plaintiff, Chief Dele John Abejirin.
The presiding Judge, Justice Fola Ajayi, who made the pronouncement during his sitting recently queried the defendant’s counsel, Humphrey Olu Agunbiade, that “court business is a serious business, it supersede any other business.
Justice Ajayi adjourned to October 27, 2014, for further hearing of the suit.
However, the plaintiff lawyer led by Umakhihe, said there were “calculated attempt by the defendant to stall the hearing of the matter, having contemptuously put the 1st defendant, Chief Mike Akin Obamero, on the throne of Oba of Gbeleko which is the subject matter of the main suit.
He called on the court to dismiss any application that is capable of delaying the hearing, as it was frivolous, vexations and an abuse of process of the Honourable court.
Meanwhile, the state counsel prayed that the court should grant them leave to recall PW1 to PW6 who testified for the plaintiff earlier but the application was also rejected subsequently same day, for state counsel to present his witnesses for cross examination.
