Kogi East Senate Tussle: Court Adjourns Till January 2018

The Federal High Court sitting in Abuja has adjourned hearing of the fresh re-trial of case involving Senator Atai Aidoko Ali and Air Marshal Isaac Alfa (rtd) to determine the authentic Senatorial candidate of Peoples Democratic Party (PDP) in the last election.
The High Court adjourned hearing till January 15, 2018 for commencement of fresh retrial of Kogi East senate seat without recourse to its referral to the Appeal Court.
Justice Binta Nyako overruled her earlier decision not to go on with the case even as lawyers of Senator Aidoko insisted on input of Appeal Court on the issue of jurisdiction of the lower court.
Recall that Nyako ruled at the last sitting referring the matter of jurisdiction of the court ‎to give a fresh retrial in line with the decision of the Supreme Court.
The Appellate Court, instead of making judicial pronouncement through the panel of its Jud‎ges, resorted to administrative decisions that directed the deputy registrar to send communication to the lower court, a move counsels to Aidoko resisted.
Aidoko’s lawyers disagreed with the High Court and insisted to follow up its earlier ruling through motions, letters, and application for proper interpretation of the matter.
The lawyers contested the decision of the Appellate Court as overriding that of the lower court.
