The battle for Kogi East Senate seat had taken another dimension as the chairman of the Appeal Court panel, Justice Stephen Adah and Justice Ige withdraws from the case following allegation of bias and vested interest by the Peoples Democratic Party (PDP).
The PDP and Senator Atai Aidoko in a joint suit disagreed with the earlier hearing and notice of judgement on the basis that Justice Stephen Adah hails from Kogi East.
According to the judges, the withdrawal became expedient having been informed of their likeness to concede judgement to the defendant.
But the petitioner averred that its actions was based on the principle of fair hearing, justice and transparency in the administration of justice in the Kogi East senate case.
PDP requested for a special panel to hear the matter earlier filed by the party and the senator soon after the judgement of the Federal High Court on the vexed Kogi East senate seat.
Justice Adah, during the last sitting, had reserved judgement of the two cases without recourse to motions and counter motions preferred against the matter.
PDP accused the two members of the panel of justices that it will amount lack of neutrality if the matter was allowed to go ahead without been opposed.
Justice Stephen Adah however said the panel will revert the case back to the chief judge for reassignment by the President of the appeal court, Justice Zainab Bulkachuwa.
