Senator representing Kogi East, Atai Aidoko Ali and the Peoples Democratic Party (PDP) has asked the Court of Appeal, Abuja division, to quash the judgement of the lower court that acted contrary to its earlier judgement on the senatorial tussle.
In a separate appeal against the judgement of the lower court along Senator Aidoko and the PDP said the lower court erred in its judgment that ordered the immediate return of his opponent, Air Marshal Isaac Alfa.
The PDP averred that as a party, the onus lies on it to produce whosoever emerged as its candidates in any contest after due considerations and insisted that Senator Atai Aidoko Ali remain the party’s candidate in the last primary held in December 2014.
In another suit filed at the Federal High Court in Abuja, Aidoko also sought for an injunction to perpetually restrain all parties in the matter to stay action and refrain from further action until the final the decision of the Appeal Court.
Twice, the Appeal Court, Abuja division, had ruled in favour of Aidoko; removing the APC Senator Abubakar Abdulrahman and Isaac Mohammed Alfa of PDP but the Supreme Court, in a separate ruling, ordered for retrial at the High Court.
Senator Aidoko was sworn in after the victory at the Appeal Court judgment in January 2017 and had since been occupying Kogi East seat in the Senate.
Two months away to PDP primaries and eight months to the elections to the National Assembly in 2019, the battle of who remain in the red chamber as the senator is still on without remorse.
The Peoples Democratic Party, on whose platform the two warring contestants belong, confirmed the submission of Senator Atai Aidoko Ali name as its candidate for the 2015 elections.
No date has been fixed for fresh hearing of the matter at the Court of Appeal, Abuja
