An Abuja High Court has restrained the Peoples Democratic Party (PDP) from conducting primary election at any level of the party structure in Kogi Local Government of Kogi state pending the hearing and determination of court processes before the High court.
This was sequel to a court order issued by Justice Valentine Ashi in a case brought before the court by the duo of Hon. Isah Shaba Ibrahim and Hon Aliyu Ibrahim against the PDP, Chairman, PDP Electoral Committee for Kogi State, Chief Maxwell Okudoh and Chairman PDP Electoral Appeal Committee for Kogi State, Engineer Bashir Awotorebo over the proposed PDP primary in the Kogi local government area.
According to the certified true copy of the court order signed by Senior Registrar of the court, Mrs Ifeoma Eze, “the defendants whether by themselves their agents, servants and privies, by whatever name called and howsoever described are hereby restrained from holding any primary election or convoke a congress of the 1st defendant party (PDP) at any level of the party structure in Kogi local government of Kogi State pending the hearing and determination of the motion on notice and the preliminary objection pending before this court.”
The court also averred that, “the motion on notice as well as the preliminary objection shall be heard together, culminating in a composite ruling, as such all filings by all the parties shall be concluded within 7 days from today (November 27).”
The court equally ordered that, “all parties shall keep and maintain the status quo as it existed this morning (November 27) accordingly neither party shall do anything that is capable of rendering nugatory the hearing and determination of the preliminary objection and the motion on notice for interlocutory injunction.”
To this end, the case was adjourned to December 10 for motion on notice and the preliminary objection.
Earlier before the court order was given, the plaintiff counsel, Barrister Emeka Obegolu had prayed the court for an interim order stopping the schedule primary but counsels to the defendants opposed him.
