The much awaited judgment in the case instituted by a Peoples Democratic Party (PDP) chieftain,  Oyebode Makinde seeking to nullify his swearing-in as the governor of Kogi State was adjourned due to the absence of Justice Abdul Kafarati of a Federal High Court sitting in Abuja.

It was gathered that the judge did not return from a journey outside of Abuja, hence the judgment was adjourned till October 11.

The suit had suffered a series of adjournments at the instance of the court since it was instituted in February.

Oyebode had, through his counsel, Alex Izinyon (SAN), asked the court to compel the Independent National Electoral Commission (INEC) to conduct a fresh governorship election in Kogi State, based on the judgment of the Supreme Court of January 27, which held that the tenure of five governors, including that of Kogi, had lapsed.

Izinyon argued that by virtue of the Supreme Court judgment, a fresh election ought to be held in Kogi State.

He said that any action taken before the judgment of the Supreme Court with regard to the governorship election in the state was a nullity.

He asked the court to grant the prayers of his client.
