A Lokoja Chief Magistrate’s Court has remanded a 21-year-old welder, Tope Joshua and Sesan Osagbemi, 19, in prison for allegedly stabbing one Moses Michael to death.
Chief Magistrate Levi Animoku ordered remand of the accused persons after they were arraigned yesterday for criminal conspiracy and culpable homicide, offences that are contrary to sections 97(1) and 221 of the Penal Code.
The prosecuting police, Mr Tuesday Ganagana, told the court that the accused committed the offences on June 30, at Makutu, Isanlu in Yagba-east Local Government Area of the state. He said one Samuel Moses, a cousin of the deceased reported at the police at Isanlu that Tope Joshua aka Adeola, Sesan Osagbemi aka Snake and one Akon conspired to commit the offence.
He alleged that the accused stabbed the late Michael on the left part of his chest and that he died while receiving treatment in a hospital. He said Akon was lynched by a mob while investigation led to the arrest of Joshua and Osagbemi.
Counsel to the accused persons Muazu Abass, urged the court to grant his clients bail.
But the prosecutor urged the court to decline the bail application and remand the accused in prison custody, saying that investigation into the case was on-going.
In his ruling, Levi Animoku declined the bail application and ordered that the accused persons be remanded at Federal Prisons, Kabba.
He then transferred the case to Chief Magistrate Court, Kabba and adjourned to August 27.
