Wife of late former President of the Academic Staff Union of Universities (ASUU), Prof. Festus Iyayi, has asked a Federal High Court in Abuja to order the arrest and prosecution of the driver of the vehicle that killed the late professor.
Iyayi died in an accident involving the convoy of Governor Idris Wada of Kogi State along the Abuja-Lokoja expressway on November 12, 2013 on his way to Kano to attend a meeting on the then prolonged university lecturers’ strike.
In an ex parte application brought yesterday, Mrs. Grace Iyayi prayed for judicial review in terms of an order of mandamus compelling the Federal Road Safety Corps (FRSC) to arrest and prosecutes Mr. Danladi Baba and Gitto Construzioni Generali Nigeria Ltd before a Magistrate Court in Lokoja, Kogi State.
According to the motion filed on her behalf by Ilum Wisdom from the chambers of Femi Falana (SAN), the driver and the firm should be charged for alleged reckless driving which occasioned the death and for creating a road hazard without adequate warning signs respectively.
Justice Adeniyi Ademola granted the application as prayed and ordered the FRSC to appear on June 6 when the substantive motion will be heard.
