Court Strikes Out Kogi Varsity’s Preliminary Objection Against Alumni Association, Awards Cost

A Kogi State High Court sitting in Anyigba has struck out the motion on notice of a preliminary objection raised by the management of Prince Abubakar Audu University Anyigba against the Alumni Association for lack of merit.

In a ruling on suit no AYHC/03/23 by the court on Thursday, the presiding Judge, Justice Ajayi awarded a cost of N20,000 as damages in favor the association.

During the sitting, counsel to the defendant, S.O. Akobe Esq argued that a new date be given to the defence counsel to come up with a proper argument or withdrawal the motion.

But counsel to the plantiff, Shuaibu Ibrahim Esq said that the defendants were not diligent in prosecution of their motion and requested the court to strike out the motion with a cost.

Justice Ajayi in his ruling struck out the motion of preliminary objection and awarded a cost in favour of the alumni association.

The case was, however, adjourned to 14th of November for further hearing.
