After a long legal battle over who is the rightful candidate of the All Progressive Council in Asuta Ward, Kabba/Bunu Legislative Council in the 2020 Kogi State Local Government Election, Barrister Segun Dare who won his case at both the lower and Appeal court last year has finally resumed today inline the court judgment that recognized him as the rightful candidate of the party in the said election.
According to him, he declared his emergence as no Victor no vanquish on Asuta Ward Councillorship tussle, describing the peoples Governor, Alhaji Yahaya Adoza Bello as an apostle of the rule of law in Nigeria.
Speaking to news men shortly after his swearing in ceremony on Monday held at the Kabba/Bunu local government Legislative chamber, Dare expressed his gratitude to “the leadership of the party under the amiable Governor Bello, who through his commitment to people driven developmental projects across the state and respect for the rule of law, which the governor again demonstrated in Asuta Ward Councillorship tussle recently rested by the Court of Appeal.”
According to him, Governor Yahyah Adoza Bello’s commitment to the rule of law and exemplary leadership in upholding democratic principles, importantly court judgements, is second to none in the history of Kogi state in particular and Nigeria in general.
It will be recalled that prior to the 12th December, 2020 local government election in Kogi State there were issues on the candidate standing for the election in Asuta ward for the All Progressives Congress (APC) in the local government council elections which largely bothered on wrongful nomination of candidate.
The issue was rested by the Kogi State High Court of Justice, Kabba. Justice Obayomi declared Barr. Segun Dare as the candidate validly nominated as the All Progressives Congress (APC) candidate for Asuta ward in the 12/12/ 2020 election.
Shortly after the verdict of the Kogi State High Court, Mr Ayo Kajotoni the 3rd defendant in the well contested suit approached the Court of Appeal, Abuja in an attempt to overturn the judgement of the Kogi state High court.
The Court of Appeal reinstating the law declined jurisdiction thereupon dismissed the appeal for lack of jurisdiction as the law upon which the election was conducted was a product of the Kogi state House of Assembly as such it is impossible to activate its jurisdiction.
Hence, the court affirmed the decision of the lower Court mandating the Kogi State Independent Electoral Commission (KOSIEC) to issue the claimant his certificate of return as earlier ordered by the Kogi State High Court.
In compliance to the judgement, Kabba/Bunu LGA legislative council sworn in Asuta Councillor.
Barr. Segun Dare, speaking after the swearing ceremony, told the news men “what a way to begin year 2022 putting our confidence in our government and the system, the commitment of the Governor being a lover of peace and law will further strengthen the confidence and hope of every Nigerians that we are all building a nation if we all support the unhidden presidential ambition of the people’s governor towards 2023 presidential election”
He thanked the Governor for his love for what is true, just and fair and he assured Bello of his unfailing loyalty to him and the new direction government and the leadership of the party at all levels.
Barr. Segun Dare conclude by extending his hands of fellowship to Mr Ayo Kajotoni whom he described as a brother and associate in building a ward they can all be proud of.
He assured Kajotoni of his determination to work with him and the leadership of All Progressives Congress in Kabba/Bunu LGA in carrying out all assignments as directed by the new direction government.
