The Supreme Court has struck out the suit filed by Alh. Yahaya Audu challenging the candidature of the senator representing Kogi East senatorial district, Sen. Jibrin Isah Echocho.

Audu through his counsel prayed the court to disqualify Isah Jibrin and declare him as the authentic winner of the October Kogi State APC senatorial primaries election held at Idah, Kogi State. The lawyer argued that the primaries was marred by intimidation of delegates, subtraction of votes and other irregularities.

The five judges in their unanimous decision as read by the lead judge, Justice Abdullahi  held that, both the high court and the appeal court were right in their separate judgments which struck out the suit.

The judge further fined Yahaya Audu five hundred thousand Naira to be paid to Sen. Jibrin Isah Echocho, another five hundred thousand Naira to the INEC and five hundred thousand Naira to the court for what was described as taking the court on the voyage of legal frivolity.

The judgment brought to halt the legal battle challenging the APC primaries election which produced Sen. Isah Jibrin. It could be recalled that the High Court struck out this case for lack of merit and the ruling was upheld by the Appeal Court.
