Senator Atai Aidoko Ali (PDP, Kogi East) has instituted a legal action at the federal high court, Abuja against the Attorney General of the Federation (AGF), Shehu Malami and INEC on the letter written to the letter commission to withdraw his certificate of return and issue a fresh one to Abdulrahman Abbubakar of the All Progressives Congress (APC).
Aidoko is seeking the court to perpetually restrain the two parties from carrying out their purported action contained in the letter as it will be tantamount to illegality and extra judicial decisions.
Aidoko’s lawyers, F.S. Jimba & Co sought for an unconditional restraint of the purported communication as an Appellate Court had already determined the case before the senator was sworn in January this year.
The Tribunal had earlier nullified the 2015 Kogi East senate election and ordered a rerun that barred APC’s Abdulrahman Abubakar. This position was later affirmed by the Appeal court.
Abubakar, who was not a candidate in the rerun or a party to the case that returned to the tribunal and Appeal court is seen to be seeking to secure victory through the back door.
Another drama was that both victories were secured against the Air Marshal Isaac Alfa (rtd) who was removed by the Court of Appeal that ordered the current senator, Atai Aidoko Ali to be sworn in subsequently.
APC’s Abdulrahman appealed Aidoko’s victory to the apex court and his case was dismissed for lacking merit and abuse of judicial process with a fine of N1m awarded against him.
The response of the Nigeria’s chief law officer is novel owing to a personalised and politically motivated stance on issues that borders on legal interpretations and adjudication on the Kogi East senate tussle.
In the interim, Justice Binta Nyako of the Federal High Court has adjourned till November to enable interested parties file appropriate response to the matter appropriately.
