Kogi East Senate Tussle: Case May Drag Beyond 2019, Judge Warns

The Federal High Court Abuja will determine the eligibility, jurisdiction and request for referral ‎to Appeal court on the contentious litigation on Kogi East senate on October 18.
Justice Binta Nyako made this known at the last hearing. She expressed concerns over the possibility of dragging the litigation beyond 2019.
She stated that in view of motions and counter motions, affidavits coupled with the peculiarities of the matter, the request for expeditious hearing by Air Marshal Alfa’s counsel, Egwuaba Rueben, is far from been realisable.
She opined that it will be judicial rascallity and abuse of process not to determine the motion for referral which is the bane of ‎the entire process of case determined by the higher court.
Senior counsel ‎to Senator Atai Aidoko, P. I. Ekweator argued exhaustively on the position of the law on the judgment of the Appeal court, whether it is justiceable or be thrown out. He argued that he relied on the court pronouncements.
Egwuaba, Isaac Alfa’s counsel, pleaded with the court to disregard the processes and motion and move ahead with the case having spent two years on the contentious seat. The judge, however, turned down the plea.
